Insurance Law and Litigation: litigation of insurance disputes, litigation of insurance bad faith claims, coverage opinion work, bad faith avoidance counseling, reinsurance litigation, and arbitration. Expert witnessing.

History
Litigation: insurance litigation, involving insurers insureds and intermediaries, subrogation contexts: class tort, property damage, and product liability cases (sometimes separate cases and sometimes involving various categories of insurance professionals,  negligent inspection by insurers employees and sometimes by others, e.g., professionals,  employer-employee problems arising out of termination, such as misappropriate of trade secrets, violations of covenants not to compete, lawyer conduct issues and wrongful discharge, business entity dissolution and attendant torts; general tort & business controversies.
Experience: Litigation

1997-: Insurance coverage disputes; litigation and arbitration of insurance and reinsurance disputes; personal injury and malpractice litigation. Helped out on some bankruptcy matters in the early 80s, and there is a trace of it even today.

1990-1995: Insurance bad faith, insurance coverage, and murder cases.

1985-1990: Product liability, construction, subrogation and negligent inspection.

1980-1990: Employment law, business litigation (and some later), and divorce (mostly helping out).

Experience: Appellate Work

I have handled (worked on), in one way or another, over 26 appeals in state and federal court.

Experience: Expert Witness Engagements

I have testified at least 130+ times in insurance matters and/or cases involving the  problems of lawyering, e.g., malpractice, fiduciary duty breaches, “ethical” problems, and so forth.

 Most of these have been by deposition; others have been in court; some have been both. I have served as a consulting expert on both of those kinds of cases many more times.  (For a more details about the divisions, see the longer resume to be found on my website or obtainable from me directly.)

Law and Law-Related Publications & Lectures or Speeches

I have published a substantial number articles, squibs, and reviews on insurance, insurance bad faith, and the law of lawyering. I have been a relatively frequent speaker on insurance matters, as well as matters pertaining to the law of lawyering. Occasionally, I have spoken on procedure and some how-to matters.
